Terms of Service

Mainline Dispatch is operated by Lead Control Media LLC.

Agreement

These Terms of Service ("Terms") govern your use of Mainline Dispatch (the "service"), operated by Lead Control Media LLC ("we," "us," "our"). By using the service, you agree to these Terms. If you do not agree, do not use the service.

The service

Mainline Dispatch is an inbound-call answering service for plumbing businesses. When configured, our AI agent receives forwarded calls, captures service request details, classifies emergencies, and delivers the information to the business owner via text message and other channels.

The service is intended to help small plumbing businesses respond to inbound calls more reliably. It is not a substitute for a licensed plumber or for emergency services.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the service. Customers must operate a legitimate plumbing or related trade business.

Your responsibilities

As a customer, you are responsible for:

  • Forwarding only your own business phone number to the service
  • Providing accurate setup information (business name, services offered, hours, dispatch preferences)
  • Responding to dispatched calls and managing your own customer relationships
  • Complying with all laws applicable to your business, including SMS, calling, and consumer protection laws

You agree not to:

  • Use the service to harass, defraud, or harm any person
  • Forward calls to numbers you do not own or control
  • Misrepresent your business to callers
  • Reverse engineer, scrape, or copy the service
  • Resell or sublicense the service without our written consent

SMS Program

SMS messages sent through the service to callers are sent only after explicit opt-in. The verbal opt-in script, sample messages, frequency, opt-out keywords, and consent audit practices are described at /sms-consent.

You agree not to instruct us to send messages that violate the Telephone Consumer Protection Act (TCPA), state SMS laws, CTIA messaging principles, or Twilio's Acceptable Use Policy. You are responsible for the content and lawfulness of messages sent on your behalf.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

Fees and payment

Service fees, billing intervals, and any free-trial conditions are presented at sign-up. Fees are non-refundable except where required by law. Failure to pay may result in suspension or termination of the service.

Service availability

We work to keep the service running but do not guarantee uninterrupted availability. We may perform maintenance, modify features, or change the service at any time. We are not liable for outages caused by third-party providers (telephony, SMS, AI), force majeure, or other circumstances outside our reasonable control.

Disclaimers

Important: The service is provided "as is" and "as available," without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

The AI agent is designed to handle a wide range of plumbing inquiries but may misunderstand callers, miscategorize urgency, or fail to capture details accurately. You are responsible for verifying details and responding to callers appropriately. The service is not a substitute for human judgment in emergencies.

Limitation of liability

To the maximum extent permitted by law, Lead Control Media LLC is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost business, lost data, or business interruption — arising from your use of the service, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from or related to the service is limited to the fees you paid us in the three months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Lead Control Media LLC, its officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the service, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) the content of messages or instructions you provide to the service.

Termination

You may cancel the service at any time, with cancellation taking effect at the end of your current billing period. We may suspend or terminate your access for breach of these Terms, non-payment, suspected fraud, or to protect the service or other users. On termination, your right to use the service ends. Sections of these Terms that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to that jurisdiction.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active customers through reasonable means, such as email or in-product notice. Continued use of the service after changes take effect constitutes acceptance.

Miscellaneous

These Terms, together with our Privacy Policy and SMS Program details, are the entire agreement between you and us regarding the service. If any provision is held invalid, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.
